What is Copyright?

Violating a copyright owner's rights can lead to penalties, including suspension of your content on Nippyfile, account suspension, or legal action. In some cases, copyright infringement can also result in criminal penalties or civil lawsuits, where the copyright holder may seek monetary damages.

How Nippyfile Handles Copyright Infringement

Nippyfile complies with the Digital Millennium Copyright Act (DMCA) and promptly removes content when properly notified of copyright infringement. To report an alleged infringement, you must submit a formal DMCA takedown notice with the necessary information.

How to File a DMCA Takedown Notice

To file a copyright infringement notification with Nippyfile, you need to send a written notice that includes the following information as required by Section 512(c)(3) of the DMCA:

  1. Your Contact Information:

    • Full legal name

    • Address

    • Phone number

    • Email address

    • Physical or electronic signature

  2. Identification of the Infringing Content:

    • Identify the copyrighted work(s) being infringed.

    • Identify the infringing content (including URLs) so we can locate it on Nippyfile.

  3. Statement of Ownership or Authorization:

    • Confirm that you are the copyright owner or an authorized agent acting on behalf of the owner.

  4. Good Faith Statement:

    • A statement that you have a good faith belief that the use of the content in question is not authorized by the copyright owner or the law.

  5. Accuracy Statement:

    • A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

What Happens After We Receive a DMCA Notice?

Upon receiving a valid DMCA takedown notice, Nippyfile will:

  • Suspend the Infringing Content: We will remove or disable access to the content reported as infringing.

  • Notify the User: We will notify the user who uploaded the content about the takedown notice.

If a counter-notification is not filed or is unsuccessful, the infringing content will remain permanently removed from Nippyfile.

Filing a Counter-Notification

If you believe your content was removed by mistake or misidentification, you can file a counter-notification. To file a counter-notification, you need to provide the following:

  1. Your Contact Information:

    • Full legal name

    • Address

    • Phone number

    • Email address

  2. Identification of the Removed Content:

    • Description of the content that was removed and the URLs where it appeared.

  3. Statement of Good Faith:

    • A statement that you have a good faith belief that the content was removed due to a mistake or misidentification.

  4. Consent to Jurisdiction:

    • Consent to the jurisdiction of the court in your area or the court where Nippyfile is based.

  5. Signature:

    • Your physical or electronic signature.

Repeat Infringer Policy

In accordance with the DMCA, Nippyfile may suspend or terminate the accounts of users who are found to be repeat infringers of copyright. If we receive multiple valid DMCA notices for a user, their account may be permanently disabled.

Limitations of Liability

Under the DMCA, Nippyfile is not liable for any infringing content uploaded by users. We act as a neutral intermediary by promptly responding to DMCA notices, but we are not responsible for monitoring or controlling user-uploaded content before it is posted.

Legal Process and Information Retention

In accordance with our Terms of Service and Privacy Policy, Nippyfile will not release non-public information about account holders except as required by law (e.g., subpoenas, court orders, or other legal processes).
